We are committed to protecting the privacy and security of our clients personal information. This privacy policy explains how we collect, use and protect personal information provided to us by our clients. This policy is in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

Collection of Personal Information

We may collect personal information from you when you contact us, make an enquiry, or request information.  This may include your name, email address, telephone number, postal address and other relevant information required to complete your enquiry.

Under the United Kingdom General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

  • Your consent. (which you may withdraw at any time).
  • The execution of a contract.

Retention of Personal Information

  • delete all non-digital material provided to us, or generated in the preparation of a case file, or arising during the NDR process within twenty-eight days of the conclusion of the mediation.
  • archive all digital material provided to us, or generated in the preparation of a case file, or arising during the NDR process within twenty-eight days of the conclusion of the mediation.
  • retain these archived materials and any digital (electronically signed) copies of the Agreement to Mediate and any Final Settlement Agreement that is generated as a result of the NDR process for seven years from the date of the conclusion of the NDR process.

Your Rights

Under data protection law, you have rights including:

  • Your right of access – You have the right to ask us for copies of your personal information.
  • Your right to rectification – You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.
  • Your right to restriction of processing – You have the right to ask us to restrict the processing of your personal information in certain circumstances.
  • Your right to object to processing – You have the right to object to the processing of your personal information in certain circumstances.
  • Your right to data portability – You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
